To be presented to the President and Members of Congress on Sept. 3, 2012 during an assembly of the people at Wash., D.C. Our jobs plans intent is to discourage American business from using China's cheap labor and for business to become self motivated to recreate their factories once again in America. We want to threaten big business wallets and curtail completely or at least slow down over time, the use of China's cheap labor for the purpose of insuring that we have full employment, a fair wage and a vibrant economy. We deserve nothing less.
PETITION
2012 Declaration of the Principles, Intentions and Demands of the Peoples Jobs Plan
The Citizens of these United States of America do hereby submit this petition demanding that the Federal Government enact a law titled Recapture America Act for the common good, preservation and security of its people as well as those yet born. The law shall incorporate the provisions enumerated below and be implemented prior to October 1, 2012.
Be it known that the people are dissatisfied with the lack of job creations and the fact that China is importing the vast majority of our goods and as a result thereof have effectively caused great harm to the citizens of these United States of America. Be it further known that it is intolerable, degrading and humiliating to our Nation that some 45 million men and women are out of work. Our intentions, demands and reasons are more clearly enumerated in our Manifesto document titled, The Peoples 2012 Jobs Plan to Reestablish the American Dream, Dated December 21,2011. Said document is incorporated and made a part of this Petition by its reference.
Provisions
No existing or new U.S. manufacturing firm, company or corporation may henceforth close all or a substantial part of its facilities for the purposes of obtaining cheap foreign labor from any country and at the same time, be allowed to maintain a business license or article of incorporation within these United States.
It shall be the policy of these United States to slow and eventual stop most all Chinese manufactured imports by enforcing a customs duty fee starting at an average of 18.8% on goods and rising in yearly increments to 35.0 % after 8 years. An exception applies when American industries do not have the knowledge, capacity and ability to produce a manufactured Chinese product. No Trade Agreement may invalidate this provision. Agriculture products, oil, gas, services, chemicals, raw materials and the like are not affected by this Plan.
An immediate U.S. business penalty tax is to be imposed on profits from those businesses that import Chinese manufactured products with a flat rate of 45 %., and rising to 75% after 8 years, with no allowable tax deductions. All other manufacturing firms, companies or corporations shall have their tax rate reduced from 35% down to 15%., with normal deductions.
If a firm,business or corporation takes over manufacturing a product previously made in China within the effective date of this legislation and they do so within 4 years, they will be given a 25 year 0% tax exemption for making it on our shores. Additionally, when a company closes its factory in the future, to make its product in any foreign country, including Mexico, such company shall be prevented from selling its products in America. A provision is included to help new small business to thrive, by relieving them from paying any income taxes for 10 years.
Any American business, who imports foreign manufactured goods for the purpose of sales to the American consumers or its third parties, shall be penalized by a flat income tax rate of 45% starting immediately, shall rise to 55% after 3 years and progress to 75% after 6 years, of their net yearly income, in lieu of the present rate of 35%. The tax code shall be immediately changed to reflect that no deductions of any kind can be made. This provision does not apply to the auto industry.
Those major business, defined as having 100 workers or more, that can substantially prove to the IRS that they now manufacture their primary product(s) upon American soil, that was once manufactured in China within the last 10 years, shall pay no Federal income taxes for 15 years
Henceforth, any new start up small business manufacturer, which is defined as having less than 20 workers, who hires and continuously retains a minimum of 8 workers shall be relieved from paying any Federal income taxes for 10 years.
All business that had previously relied, in the past 5 years, on a completed imported product from China but are now manufacturing such product for themselves within the U.S shall be relieved from paying any Federal income taxes for the next 8 years, provided they have hired and retained 10 workers or more. The reassemble of components in order to make a complete product does not qualify under this provision.
